1. Introduction

California Subcontractor Healthcare Construction Network (“CASHCN”) is a trade name and a dba of Bay Area Chapter, ASA, Inc. (“BASA”).  CASHCN has created this policy statement to help users of this Web site understand how we collect, use, and protect information about them. The term "user" in this policy statement refers to visitors of this Web site. The term "collected information" refers specifically to information collected from this Web site. This Privacy Policy incorporates and supplements the CASHCN Terms of Use Agreement.

2. Information Collected

For each visitor to this Web site, this Web server automatically recognizes the user's domain name, IP address, and certain information about the user's equipment (e.g., type of browser, screen resolution, support for Java). Our server does not automatically record or recognize user–specific, personal information. Such information (e.g., e–mail address, telephone number, title, subject interests, payment information) is collected by our server only when volunteered by the user (e.g., when a user uses the site to complete pre-qualification information, register for a meeting, purchase a product, or complete or revise a user profile) and is recognized by the server only if the user logs in. We use cookies only to store user preferences and to record session information (e.g., user password, items added to a shopping cart). We do not knowingly allow ad server companies to collect information from this site. Credit card information is recorded only for completion of transaction for which it was provided and is not stored for long–term use.

3. Use of Collected Information

CASHCN’s primary objective in collecting user information is to provide the best member and customer service possible. User–specific information that is provided by the user is normally incorporated into CASHCN’s general member and contacts database. CASHCN occasionally shares some collected information with member and nonmember individuals, such as when we provide attendees of a CASHCN event with a registrants list containing contact information. CASHCN generally does not sell or trade collected information to third parties specifically for commercial use other than those parties who are the intended recipients of such information, as described in this website, but does provide limited member information to third parties. This includes, e.g., membership lists shared with reputable organizations with which CASHCN has an established business relationship, including BASA, American Subcontractors Association, California, Inc. (“ASAC”), and American Subcontractors Association, Inc. (“ASA”), Membership Directories, and this site's "Find a Member" service.

CASHCN will share user information with selected other users of the site for the purpose of executing requests for CASHCN –endorsed products, services, and resources, and for the purpose of notifying users of additional CASHCN – endorsed products, services, statements, and resources.

CASHCN will share with any other registered user of the site any information provided by user on any Prequalification Information Form.  By posting information on a Prequalification Information Form, user expressly authorizes CASHCN to share such Prequalification Form information.  CASHCN will not share such Prequalification Form information with any other person for any other purpose without user’s specific consent.

You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); and (2) protect or defend CASHCN, or a third party’s, rights or property.

4. Opportunity to Opt Out

Because collected information volunteered by the user is automatically stored in CASHCN’s member and contacts database along with information collected by means other than this site, it is not possible to opt out from the use of collected information. However, users may submit a request to limit marketing or to avoid specific types of communication (e.g., mail, fax, e–mail) or specific BASA, ASAC, or ASA publications (e.g., newsletters) by contacting the BASA Membership Department by e–mail at sabrina@asabayarea.org or by telephone at (925) 680-1166.

5. Security

This site and the servers that store collected information have industry–standard security measures in place to protect against the loss, misuse, and alteration of the information under CASHCN’s control. Please note, however, that no security system is 100% secure. Authentic CASHCN Web pages requesting credit card information will be secure Web pages, and sensitive data will be encrypted for transmission. CASHCN does not absent user consent knowingly share credit card numbers with third parties except to the extent necessary and incidental to the purposes for which the user supplied the information.

6. Links to Other Web Sites

This site contains links to other Web sites, some of which may look similar to this site and appear to be a part of this site. CASHCN is not responsible for the privacy practices, content, or security of such sites.

7. Changes to Policy and Deviation from Policy

CASHCN reserves the right to revise this policy and to use collected information for uses not previously disclosed without prior notice and at any time. If policy changes are made, a revised policy will be posted on this page. Although every effort has been made to provide complete and accurate information, BASA makes no warranties, express or implied, or representations as to the accuracy of content on or obtained through this website. BASA assumes no liability or responsibility for any errors or omissions in the information contained in the website or the operation of the website.  
 
By using the BASA website, you assume all risks associated with the use of this site including any risk of your computer, software or data being damaged by a virus, software, or any other files which might be transmitted or activated via the BASA website.  BASA expressly disclaims any liability for any special, incidental, or consequential damages, including without limitation, lost revenues, or lost profits, resulting from the use or misuse of the information contained in the website.
